1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither for commercial nor for self-employed professional activities. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

2. Contract Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with MISKI. By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order at any time by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation via email.

3. Contract Language, Contract Text Storage

The language(s) available for concluding the contract: German. We store the contract text and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Conditions

We offer free shipping. We deliver only via shipping. Unfortunately, self-pickup of the goods is not possible. We do not deliver to parcel stations.

5. Payment

In our shop, you generally have the following payment options:

  • Prepayment: If you choose prepayment as the payment method, we will provide you with our bank details in a separate email and deliver the goods after payment has been received.
  • SEPA Direct Debit: By placing the order, you authorize us to collect the payment amount via SEPA direct debit. We will inform you of the date of the debit at least one banking day in advance (so-called prenotification). A banking day is any weekday except Saturdays, national public holidays, and December 24 and 31 of each year. The debit will occur before the goods are shipped.
  • PayPal: To pay via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is executed by PayPal immediately after placing the order. Further information will be provided during the ordering process.
  • Sofort by Klarna: To pay via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information will be provided during the ordering process.
  • Google Pay: To pay via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is executed immediately after placing the order. Further information will be provided during the ordering process.
  • Apple Pay: To pay via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction.   • giropay / paydirekt: In cooperation with the payment service provider paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt a. M ("giropay" or "paydirekt"), we offer the payment options giropay and paydirekt.
    • giropay: To pay via giropay, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after placing the order. Further information will be provided during the ordering process.
    • paydirekt: To pay via paydirekt, you must have an online banking-enabled bank account, be registered with paydirekt, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is executed immediately after placing the order. Further information will be provided during the ordering process.
  • Amazon Pay: To pay via the payment service provider Amazon Payments Europe S.C.A., 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is executed within one banking day after placing the order. A banking day is any weekday except Saturdays, national public holidays, and December 24 and 31 of each year.   • Klarna: In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information will be provided with the respective payment option and during the ordering process.
    • Purchase on Account via Klarna: The invoice amount is due 14 days after shipment of the goods and receipt of the invoice.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us as soon as possible. Failure to make a complaint or contact us will not affect your legal rights and their enforcement, particularly your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

9. Liability

We are liable without limitation for claims arising from damage caused by us, our legal representatives, or vicarious agents in the case of injury to life, body, or health, in cases of intentional or grossly negligent breaches of duty, for guarantee promises if agreed, or if the scope of the Product Liability Act is opened. In the case of breach of essential contractual obligations, the fulfillment of which is necessary to achieve the proper execution of the contract and on which the contractual partner regularly relies (cardinal obligations) due to slight negligence by us, our legal representatives, or vicarious agents, liability is limited to the damage foreseeable at the time of the contract conclusion, with whose occurrence one typically has to reckon. Otherwise, claims for damages are excluded.
